TriventGO — Terms of Use / End User License Agreement (EULA)

These Terms of Use (“Terms”) are a binding legal agreement between you (“you,” “your,” or “User”) and Trivent Safety Consulting (“Trivent,” “we,” “us,” or “our”), a company located in Wheat Ridge, Colorado, USA, governing your access to and use of the TriventGO mobile application for iOS and Android, together with all related features, content, and services (collectively, the “App” or the “Service”).

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT SAFETY DISCLAIMERS, LIMITATIONS OF LIABILITY, AND OTHER PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS.

Safety notice. TriventGO is an informational tool. It is not a substitute for professional judgment, formal safety training, a qualified safety professional, a physician, or a regulator. In an emergency, call 911 (or your local emergency number) immediately. Do not rely on the App’s output as your sole basis for any safety-critical decision. See Sections 3 and 10.

1. Acceptance of These Terms

By downloading, installing, accessing, or using the App — or by tapping “Agree,” “Continue,” “Subscribe,” or a similar control — you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference and available at https://www.triventsc.com/privacy-policy/.

If you do not agree to these Terms, do not download, install, access, or use the App.

You represent that you are at least the age of majority in your jurisdiction, or that you are of legal age to form a binding contract and are using the App with the consent of a parent or legal guardian where required. The App is not directed to children.

If you are using the App on behalf of an employer or other organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to both you and that organization.

2. Description of the Service

TriventGO is a mobile application built by Trivent Safety Consulting to help workers, supervisors, and safety personnel access occupational safety information quickly. The App’s tagline is “Three taps to a safer jobsite.” The App offers:

  • Ask AI — an artificial-intelligence assistant that answers questions about U.S. OSHA occupational safety, scoped to 29 CFR 1910 (General Industry) and 29 CFR 1926 (Construction), with citations to specific standards. Ask AI is powered by Claude, an AI model provided by Anthropic, accessed through Trivent’s backend. Free users receive a limited number of AI queries per month; unlimited queries are a Pro feature.
  • Hazard Review (Pro) — submit a jobsite photo and description for review by a Trivent consultant.
  • My Certifications — track safety-certification expirations and receive optional on-device reminders.
  • Toolbox Talks & Premium Modules — safety content, with additional modules available to Pro subscribers.
  • For Teams and external links — B2B information plus links to book a class, request a quote, and get directions to Trivent’s training center.

The App is provided in the English language, for portrait orientation, with a dark interface, and operates on a device-based model — no user account is required or created. We may add, modify, suspend, or discontinue any feature of the App at any time, as described in Section 12.

3. AI Answers Are Informational Only — Safety & No-Reliance Disclaimer

This Section is a material term of these Terms.

The Ask AI feature generates answers automatically using a third-party AI model. AI-generated content can be incomplete, out of date, or wrong, and may not reflect your specific jobsite, equipment, jurisdiction, employer policies, or the most current regulations. Accordingly:

  • Informational only. AI answers, citations, Toolbox Talks, Premium Modules, and all other content in the App are provided for general informational and educational purposes only. They are not professional, legal, regulatory, engineering, occupational-safety, or medical advice, and do not create any professional or consulting relationship.
  • No professional substitute. The App is not a substitute for a qualified safety professional, a competent person as defined by OSHA, formal training, an official OSHA determination, an attorney, an engineer, or a licensed medical provider. Always verify safety-critical information against the authoritative source (e.g., the current Code of Federal Regulations, the manufacturer’s instructions, and your employer’s safety program) and consult a qualified professional before acting.
  • No medical advice; no diagnosis or treatment. The App does not diagnose, treat, cure, or prevent any disease, injury, or medical condition, and nothing in the App should be interpreted as medical advice. First-aid or health-adjacent information is general and educational only. Consult a licensed healthcare professional for any medical concern.
  • Emergencies. The App is not an emergency service and does not connect you to emergency responders. If there is an emergency, a serious injury, or an immediate threat to life or safety, call 911 (or your local emergency number) immediately.
  • No open web browsing. Ask AI does not browse the open internet and may not have knowledge of the most recent regulatory changes or events.
  • Your responsibility. You are solely responsible for evaluating, verifying, and deciding whether and how to use any information the App provides. Any reliance you place on the App’s output is strictly at your own risk.

By using the App, you acknowledge and agree to this disclaimer. It is reflected in the limitations of liability and warranty disclaimers in Sections 9 and 10.

4. Subscriptions, Billing & Free Trial (Trivent Pro)

The App offers a paid auto-renewing subscription, Trivent Pro, which unlocks Pro features (including unlimited Ask AI, Hazard Review, and Premium Modules).

4.1 Price and billing period

  • Trivent Pro is US $29.00 per month (or the equivalent in your local currency and applicable taxes as shown at purchase).
  • The subscription automatically renews each month unless canceled at least 24 hours before the end of the current period.
  • Your payment method is charged at confirmation of purchase and, unless canceled, at the start of each renewal period.

4.2 Free trial

  • Trivent Pro may be offered with a 7-day free trial for eligible new subscribers.
  • Trial eligibility is determined by the applicable app store (Apple or Google) based on your prior use of introductory offers; the App displays trial copy only when you are eligible.
  • If you do not cancel before the trial ends, your subscription automatically converts to a paid monthly subscription and your payment method is charged the then-current price.
  • Any unused portion of a free trial is forfeited if you upgrade to a paid subscription before the trial ends. Free-trial time cannot be transferred, refunded, or carried over.

4.3 Payment through the app stores (native in-app purchase only)

  • All subscription purchases are processed exclusively through Apple’s In-App Purchase / StoreKit (for iOS) or Google Play Billing (for Android). Subscription entitlements are managed on our behalf by RevenueCat.
  • Trivent does not sell subscriptions through any external or web-based checkout inside the App and never receives or stores your credit-card or payment-account details. Payment is handled by Apple or Google.
  • Your purchase is also subject to the terms of the app store through which you subscribe (the Apple Media Services Terms and Conditions or the Google Play Terms of Service).

4.4 Managing, canceling & restoring

  • Manage or cancel your subscription at any time through your Apple App Store account settings (iOS) or your Google Play subscriptions (Android). Deleting the App does not cancel your subscription.
  • Cancellation takes effect at the end of the current billing period; you retain Pro access until then. Downgrades and cancellations do not entitle you to a partial-period refund except where required by law.
  • Restore Purchases. If you reinstall the App or use a new device, you can restore an active subscription using the Restore Purchases control available in both the paywall and the in-app Settings screen.

4.5 Refunds

Because billing is handled by the app stores, all refund requests are governed and processed by Apple or Google under their respective policies. Trivent generally cannot issue refunds directly for app-store purchases. You may request a refund through Apple (reportaproblem.apple.com) or Google Play as applicable, subject to their terms and any non-waivable rights you have under applicable law.

4.6 Price and offer changes

We may change subscription prices, features, or the availability of introductory offers. Where required, changes to your renewal price will be communicated to you and, where the app store requires, your consent will be obtained before the new price takes effect. Price changes do not apply retroactively to a period already paid.

5. License Grant & App Store Terms

Subject to your compliance with these Terms, Trivent grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on a device that you own or control, for your personal or internal business use. This is a license, not a sale; Trivent and its licensors retain all rights not expressly granted.

Where you obtain the App from the Apple App Store, this license is further limited by, and incorporates, the usage rules of the Apple Media Services Terms and the Apple Standard EULA (see Section 13).

6. Acceptable Use & AI Misuse

You agree to use the App only for lawful purposes and in accordance with these Terms. You will not, and will not attempt to, and will not permit others to:

  • Use the App or Ask AI to generate, solicit, or facilitate anything unlawful, harmful, harassing, deceptive, or dangerous, or that infringes the rights of others.
  • Attempt to circumvent, disable, or defeat the App’s safety guardrails, content scope, moderation, refusals, or usage limits — including by prompt injection, jailbreaking, or adversarial prompting — or to elicit output outside the App’s OSHA occupational-safety scope.
  • Submit content you have no right to submit, or upload photos or descriptions that contain other people’s personal, confidential, or proprietary information without authorization.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent this restriction is prohibited by applicable law.
  • Copy, modify, distribute, sell, sublicense, rent, lease, or create derivative works of the App or its content, except as expressly permitted.
  • Access the App or its backend by automated means, scrape content, overload or interfere with our systems, probe or test the vulnerability of our systems, or exceed rate limits imposed to protect the Service.
  • Use the App to build, train, or improve a competing product or AI model, or to resell or redistribute AI output as a standalone product.
  • Misrepresent AI-generated output as human-authored professional advice, or hold the App out as an accredited source of legal or regulatory determinations.

We may, in our reasonable discretion and without liability, suspend, limit, or terminate your access to the App (or specific features) for actual or suspected violation of this Section, or to protect the Service, its users, or third parties. You are responsible for your use of the App and for any content you submit through it.

7. Reporting AI Content

Every AI answer includes an in-app Report control. If AI output appears objectionable, unsafe, inaccurate, or otherwise inappropriate, please report it; reports are logged and routed to Trivent for review. Reporting helps us improve safety and moderation and is part of our commitment to responsible AI. We may act on reports at our discretion, but we do not guarantee any particular outcome or response time.

8. Intellectual Property

8.1 Trivent property

The App and all of its content, features, and functionality — including software, text, Toolbox Talks, Premium Modules, graphics, logos, the “TriventGO” and “Trivent Safety Consulting” names and marks, and the overall design — are owned by Trivent or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual-property laws. Except for the limited license in Section 5, no rights are granted to you.

8.2 Your content

“User Content” means content you submit through the App, such as hazard photos, descriptions, contact details, and the text of your AI prompts. You retain ownership of your User Content. You grant Trivent a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and use your User Content solely to operate, provide, secure, and improve the Service (for example, to send a hazard submission to Trivent’s safety team, to obtain an AI answer from Anthropic, and to review reported output), consistent with our Privacy Policy. You represent that you have the rights necessary to submit your User Content and to grant this license.

8.3 AI output

Subject to these Terms and to Anthropic’s applicable terms, and as between you and Trivent, you may use the AI answers the App generates for your own informational and internal business purposes. Because AI output is generated automatically and may not be unique, Trivent makes no representation that output is original or that you hold exclusive rights in it, and you remain subject to the disclaimers in Section 3.

8.4 Feedback

If you send us suggestions or feedback about the App, you grant Trivent a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you.

9. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL CONTENT, INCLUDING AI-GENERATED OUTPUT, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

Trivent and its suppliers, licensors, and service providers expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.

Without limiting the foregoing, Trivent makes no warranty that: (a) the App or its content, citations, or AI output will be accurate, complete, reliable, current, or error-free, or suitable for any safety-critical, regulatory, medical, or life-safety purpose; (b) the App will be uninterrupted, secure, or available; or (c) defects will be corrected.

You acknowledge that occupational safety and health decisions carry inherent risk, that AI output can be wrong, and that you must independently verify any information before relying on it. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • Trivent and its owners, officers, employees, consultants, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the App or these Terms, even if advised of the possibility of such damages.
  • Without limitation, Trivent will not be liable for any injury, illness, death, property damage, regulatory citation, fine, business interruption, or other loss arising from your reliance on, or use of (or inability to use), any AI output, safety information, citation, Toolbox Talk, Premium Module, hazard review, certification reminder, or other content in the App. You are responsible for your own safety-critical decisions.
  • Trivent’s total aggregate liability for all claims arising out of or relating to the App or these Terms will not exceed the greater of (a) the total amount you paid Trivent for the subscription in the twelve (12) months before the event giving rise to the claim, or (b) US $50.00.

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), form part of the basis of the bargain, and survive termination. Some jurisdictions do not allow certain limitations, so some of these may not apply to you; in that case Trivent’s liability is limited to the maximum extent permitted by law.

11. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Trivent and its owners, officers, employees, consultants, suppliers, and licensors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the App; (b) your User Content; (c) your violation of these Terms or of any applicable law; (d) your reliance on any content or AI output in the App; or (e) your violation of the rights of any third party. Trivent may assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate.

12. Changes to the App

We may add, change, suspend, or discontinue any part of the App — including features, content, usage limits, and subscription offerings — at any time, with or without notice, except as otherwise required by law or by an active subscription commitment. We are not liable to you or any third party for doing so.

13. App Store–Specific Terms

These provisions apply when you obtain the App from a third-party app store.

13.1 Apple App Store

You acknowledge that these Terms are between you and Trivent only, not with Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to furnish maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or a third party relating to the App, including product-liability, legal-or-regulatory-compliance, and consumer-protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting,” and are not on any U.S. Government restricted-party list. Your use must comply with applicable third-party terms (e.g., your wireless data plan).

13.2 Google Play

Your use of the App obtained from Google Play is also subject to the Google Play Terms of Service. As between Trivent and Google, Trivent is solely responsible for the App.

14. Third-Party Services

The App relies on third-party service providers to function, including Anthropic (AI model provider for Ask AI), Render (backend hosting and database), Postmark (transactional email), RevenueCat (subscription entitlement management), and Apple and Google (distribution and payment). The App may also link to external websites (e.g., www.triventsc.com pages to book a class or request a quote). Trivent does not control third-party services or websites and is not responsible for their content, availability, or practices. Your use of certain features may be subject to those third parties’ terms and privacy policies. How data is shared with these providers is described in our Privacy Policy.

15. Term & Termination

These Terms remain in effect while you use the App. You may terminate by ceasing use and uninstalling the App (and, to stop a subscription, canceling through the applicable app store — see Section 4.4). We may suspend or terminate your access at any time for violation of these Terms or as otherwise permitted here. Upon termination, the license in Section 5 ends. Sections that by their nature should survive — including Sections 3, 6, 8–11, 16, and 17 — survive termination.

16. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to them or the App are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules. Subject to any non-waivable rights you have under the laws of your place of residence, you and Trivent agree that the state and federal courts located in Colorado will have exclusive jurisdiction, and you consent to personal jurisdiction and venue there. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing in this Section limits any mandatory consumer-protection rights available to you under local law.

17. General

  • Entire agreement. These Terms, together with the Privacy Policy and any app-store terms, are the entire agreement between you and Trivent regarding the App and supersede any prior agreements on this subject.
  • Severability. If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions remain in full force.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. Trivent is not liable for delays or failures caused by events beyond its reasonable control.
  • Notices. We may provide notices through the App or by posting to the hosted Terms page.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and post the updated Terms at https://www.triventsc.com/terms/. Material changes will be communicated as required by law or app-store policy. Your continued use of the App after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree, stop using the App and cancel any subscription.
